For the purposes of UK data protection law, Devon LAMDA is the data controller for the personal information described in this policy. This means we are responsible for deciding how and why that information is used.

5. Our lawful basis for using personal information
Under the UK General Data Protection Regulation (UK GDPR), we must have a lawful basis for processing personal information.
Depending on the circumstances, we may rely on:
Contract – where processing is necessary to provide lessons or another service that has been booked or requested.
Legal obligation – where we need to process information to comply with a legal requirement.
Legitimate interests – where processing is reasonably necessary to operate and administer Devon LAMDA, communicate effectively with families, maintain appropriate records, protect our services or improve how we operate, provided those interests are not overridden by an individual's rights and interests.
Consent – where we specifically ask for permission to use information for a particular purpose, for example certain uses of photographs or video. Consent can be withdrawn at any time.
Vital interests – in exceptional circumstances where using or sharing information is necessary to protect someone's life or physical safety.
6. Medical information, disabilities and additional needs
Information about health, disabilities and certain additional needs may constitute special category personal data under UK data protection law.
We only ask for information of this kind where it is relevant and necessary, for example to enable us to support a student appropriately, make reasonable adjustments, or respond safely in an emergency.
Where required, we will obtain explicit consent to process this information. In other circumstances, another appropriate condition under data protection law may apply, for example where processing is necessary to protect someone's vital interests or to establish, exercise or defend legal claims.
We take particular care to keep this information secure and restrict access to those who genuinely need it.
7. Children's personal information
As Devon LAMDA works primarily with children and young people, protecting their personal information is particularly important to us.
We collect only information that is relevant to providing tuition and operating our services safely.
Registration and booking information will normally be provided by a parent or guardian. As children become older and are able to understand how their information is being used, they may also have rights over their own personal information.
We aim to explain the use of personal information clearly and in a way that is appropriate to the age and understanding of the child or young person concerned.
8. Photographs and video
From time to time, photographs or video may be taken during lessons, workshops, performances or other Devon LAMDA activities.
Where photographs or recordings are intended to be used for promotional purposes — such as on our website, social media, printed materials or other marketing — we will obtain appropriate permission before doing so.
Giving permission for promotional photography or video is optional and will not affect a child's ability to take part in Devon LAMDA lessons.
Permission can be withdrawn for future use by contacting us. Please note that it may not always be possible to withdraw material that has already been printed, published or shared by others.
9. Who we share information with
We only share personal information where it is necessary and appropriate.
This may include:
Teachers or other authorised individuals involved in delivering Devon LAMDA services
LAMDA or other relevant examination bodies where an examination entry has been requested
Venues or organisations hosting lessons or activities where information is genuinely required
Service providers that help us operate our business, such as website, email, cloud storage, booking, payment or accounting providers
Professional advisers, insurers or regulatory bodies where necessary
Emergency services, healthcare professionals, safeguarding authorities or other relevant organisations where necessary to protect a child or another person's welfare or safety
Law enforcement or other authorities where we are legally required to provide information
We only share the information reasonably necessary for the relevant purpose.
Where another organisation processes personal information on our behalf, we take appropriate steps to ensure that it handles the information securely and in accordance with data protection law.
10. LAMDA examination entries
Where a student chooses to enter a LAMDA examination, it may be necessary to provide personal information to LAMDA (London Academy of Music & Dramatic Art) or another organisation involved in administering the examination.
This may include the student's name, date of birth, examination details and other information required to process the examination entry.
Once information has been provided to an examination body, that organisation may act as a separate data controller and its own privacy policy will apply to its use of the information.
11. How we store and protect personal information
We take reasonable technical and organisational measures to keep personal information secure.
These may include:
Password-protected devices and accounts
Restricted access to personal information
Two-factor authentication where available
Secure cloud-based systems
Keeping sensitive information accessible only to those who need it
Keeping software and devices appropriately secured and updated
No system can guarantee absolute security, but we take appropriate precautions having regard to the nature and sensitivity of the information we hold.
12. International data transfers
Some of the third-party services we use — for example website hosting, cloud storage, email, payment or administration services — may process or store information outside the United Kingdom.
Where personal information is transferred internationally, we take appropriate steps to ensure that it receives a level of protection required by UK data protection law. This may include relying on UK adequacy regulations or appropriate contractual safeguards.
13. How long we keep information
We keep personal information only for as long as it is reasonably necessary for the purpose for which it was collected, including to meet legal, accounting, insurance and safeguarding requirements.
As a general guide:
Enquiry information that does not result in registration will normally be deleted when it is no longer required.
Information relating to current students will normally be retained for the duration of their time with Devon LAMDA.
General student and parent/guardian records may be retained for up to three years after a student leaves Devon LAMDA, unless there is a reason to keep particular information for longer.
Financial and accounting records may be retained for six years where required for tax, accounting or legal purposes.
Safeguarding records may need to be retained for longer in accordance with applicable safeguarding guidance and legal requirements.
Photographs and video used with consent may be retained until they are no longer required for the purpose for which permission was given or consent is withdrawn, subject to material already published.
We periodically review the information we hold and securely delete or dispose of information that is no longer required.
14. Marketing communications
We may occasionally contact parents or guardians with information about Devon LAMDA lessons, workshops, courses or other relevant services.
Where consent is required for electronic marketing, we will ask for it.
You can ask us to stop sending marketing communications at any time. This will not prevent us from sending essential administrative messages relating to lessons or services you have booked.
15. Website and cookies
Our website may use cookies and similar technologies.
Some cookies are necessary for the website to function. Other cookies, such as those used for analytics or marketing, will only be used where permitted by law and, where required, after you have given your consent.
You can manage your cookie choices through the cookie controls available on our website and through your browser settings.
Further information about the cookies used on devonlamda.co.uk should be provided through our website's cookie notice or cookie settings.
16. Your data protection rights
Depending on the circumstances, you may have the right to:
Ask for access to the personal information we hold about you
Ask us to correct inaccurate or incomplete information
Ask us to delete personal information
Ask us to restrict how we use personal information
Object to certain uses of personal information
Ask for certain information to be transferred to you or another organisation
Withdraw consent at any time where we rely on consent
These rights are not absolute and whether they apply will depend on the circumstances and the lawful basis on which information is being processed.
Children also have data protection rights in relation to their personal information. Depending on their age and level of understanding, they may be able to exercise those rights themselves.
To exercise a data protection right, please contact us using the details below.
17. Automated decision-making
Devon LAMDA does not use personal information to make solely automated decisions about students that have legal or similarly significant effects.
18. Providing personal information
Some personal information is necessary for us to provide our services safely and effectively.
If required information is not provided, we may be unable to register a student, provide a particular service, enter a student for an examination or safely accommodate particular medical or additional needs.
Where providing information is optional, we will make this clear where appropriate.
